Terms & conditions

1Applicability

These terms and conditions apply to all offers, quotes, orders and agreements between Formr and you as a customer. Deviations only apply if we have confirmed them in writing (including by email).

2Offer and prices

All prices are in euros and include VAT. Shipping costs are shown separately at checkout. For products with options the price shown is a 'from' price; the final amount depends on your choices (size, material, quantity). Product photos are for illustration: colors may differ due to screen settings and the production process. Obvious errors or mistakes in an offer don't bind us.

3Formation of the agreement

The agreement is formed once you place an order and we confirm receipt by email. For the Print Service, the agreement only arises when you approve the quote we provide. A quote is valid for 30 days unless stated otherwise.

4Payment

Payment is made via iDEAL, handled by Stripe. Payment is made in advance; we don't store full payment, account or card details ourselves. The product remains the property of Formr until payment has been received in full.

5Right of withdrawal

Shop. The statutory right of withdrawal applies to shop products: you may cancel the purchase within 14 days of receipt without giving a reason. Notify us within that period at info@formr3d.nl and return the product within 14 days of your notification, as far as possible in its original condition and packaging. The direct cost of returning the item is yours. We refund the purchase amount including the standard shipping cost of the original delivery within 14 days of your withdrawal, and we may wait until we have received the product or you have shown that you have sent it back. We may deduct any reduction in value resulting from handling the product beyond what was needed to assess it.

6Print Service terms

• Quote first — we assess your file (STL, 3MF, STEP, OBJ) broadly for printability in advance and send a no-obligation quote. We only print after you've approved it. Our assessment is an estimate and offers no guarantee of a perfect end result if the source file contains structural errors.
• Refusing jobs — we reserve the right to refuse a request without giving a reason, for example when it conflicts with legislation, third-party rights or our operations, or when we expect the job can't be carried out well technically.
• Rights to your file and indemnity — by submitting a file you represent and warrant that you have the right to have this file printed and that the print doesn't infringe any (intellectual property) rights of third parties. We don't actively check submitted designs for infringement; that responsibility lies entirely with you. You indemnify Formr against all third-party claims and any resulting damage and costs. We use your file solely to carry out your job.

7Product characteristics and use

• Characteristics of 3D printing — the production process can cause small differences in color, dimensions, layer structure, gloss, surface finish and minimal traces of support material. These characteristics are inherent to 3D printing and are not defects.
• Designs and licences — we offer the designs in our shop with the necessary usage rights for production by Formr.
• Intended use — our products are intended for normal private use unless stated otherwise. You are responsible for assessing whether a product is suitable for a specific purpose.

8Delivery and shipping

Stated delivery times (around 3–5 business days) are indicative and start once payment has been received and production can begin. We deliver within 30 days at the latest, unless we agree otherwise together; if that unexpectedly doesn't work out, we'll let you know as soon as possible and you can cancel the order free of charge. We ship within the Netherlands and Belgium; if you'd like delivery to another country, please contact us first at info@formr3d.nl, as checkout only accepts a Dutch or Belgian address. Orders of €75 or more within the Netherlands ship for free; this threshold doesn't apply to delivery in Belgium. The risk of damage or loss during transport lies with Formr until the moment of delivery to you or a recipient you've designated. Exceeding an indicative term doesn't entitle you to compensation.

9Complaints and defects

We check every print by hand before it ships. We ask you to check your order as soon as possible after receipt. Did your order arrive damaged or not as agreed? Let us know as soon as possible after discovery at info@formr3d.nl, ideally with a clear photo. If the complaint is justified, we'll arrange a suitable solution: free repair, a new print or a (partial) refund.

10Force majeure

We aren't liable for delay or failure to meet obligations if this results from force majeure — circumstances beyond our reasonable control, such as equipment failures or defects, supplier or material shortages, power or internet outages and transport problems. If the force majeure lasts longer than 30 days, both you and we may dissolve the agreement; we'll then refund any amounts already paid for undelivered products.

11Liability

To the extent permitted by law, our total liability for an attributable failure is limited to compensation for direct damage up to a maximum of the amount of the relevant order, except in the case of intent or deliberate recklessness. We aren't liable for indirect or consequential damage, for damage caused by incorrect, careless or improper use of a product, or for defects resulting from errors in a file you supply. Nothing in these terms limits your mandatory consumer rights.

12Governing law and disputes

Dutch law applies to these terms. Do you have a complaint or can't we work something out? Please contact us first at info@formr3d.nl so we can look for a solution together. If that doesn't work, you can bring the dispute before the competent Dutch court. As a consumer you retain all rights the law grants you.

Our privacy policy applies to the processing of personal data.
